PONCE GRAPPLING, LLC DBA RENZO GRACIE PONCE
RELEASE OF LIABILITY AND PHOTO/VIDEO CONSENT AGREEMENT
This Release of Liability (the “Agreement”) is entered into by and between Ponce Grappling, LLC Dba Renzo Gracie Ponce (the “School”) and the undersigned participant (the “Student”). By signing this Agreement, the Student (or Parent/Guardian, if the Student is a minor) acknowledges and agrees to the following terms:
1. Assumption of Risk
The Student acknowledges that martial arts training, including but not limited to Brazilian Jiu-Jitsu and No-Gi Grappling, involves physical activity that may carry inherent risks of injury, including but not limited to sprains, strains, bruises, broken bones, or other serious injuries. The Student voluntarily assumes all risks related to participation in these activities, understanding that participation is at their own risk and discretion.
2. Release of Liability
In consideration of being permitted to participate in any martial arts classes, training, seminars, competitions, or events at or through the School, the Student hereby releases, waives, and discharges Ponce Grappling, LLC, its owners, instructors, staff, agents, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action for personal injury, property damage, or wrongful death arising out of or related to participation in any martial arts activity or use of the School’s facilities or equipment, whether caused by negligence or otherwise, to the fullest extent allowed by law.
3. Medical Conditions
The Student confirms that they are physically fit to participate in martial arts training and have no medical conditions that would inhibit participation or increase the risk of injury. The Student agrees to inform the School of any medical conditions prior to participating in any classes or events. If the Student feels unwell, injured, or otherwise unable to participate safely, they agree to immediately notify an instructor.
4. Photo and Video Consent
The Student grants permission for the School to take and use photographs and videos of them during classes, competitions, seminars, and other school-related activities. These images and videos may be used by the School for marketing, advertising, or promotional purposes on various media platforms, including but not limited to websites, social media, brochures, and newsletters. The Student waives any right to royalties or compensation arising from the use of these images or recordings.
5. 24-Hour Video Surveillance
The Student acknowledges that the School’s facilities, including both the interior and exterior, are under 24-hour video surveillance for security and safety purposes. By participating in classes and activities at the School, the Student consents to being recorded on video while in or around the School’s premises.
6. Indemnification
The Student agrees to indemnify and hold harmless the Released Parties from any claims, lawsuits, damages, or expenses (including legal fees) arising from the Student’s participation in martial arts activities or presence at the School’s facilities, whether caused by the Student’s own actions or the actions of others.
7. Severability
In the event that any provision of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to principles of conflicts of law.
9. Acknowledgment of Understanding
The Student acknowledges that they have read this Agreement fully, understand its contents, and sign it voluntarily, intending to be legally bound by its terms.
